CANCELLATION – REFUND – MODIFICATION AND FORCE MAJEURE TERMS KERVEL TURİZM

Article 1 – Force Majeure, Cancellation, Postponement, and Modification of the Tour Despite having shown all necessary care, the agency may unilaterally cancel, postpone, or make changes to the entire tour program or a part of it due to all force majeure events that prevent the start or continuation of the tour. Such events include, but are not limited to, failure to reach a sufficient number of participants, adverse weather conditions, road blocks, natural disasters, strikes, terrorist incidents, the possibility of war, fog, decisions by official authorities, unforeseeable technical failures, and transportation disruptions.

In such cases, the agency has no fault, liability, obligation to pay compensation, or obligation to refund additional fees.

The agency may notify of cancellations, postponements, or changes less than 24 hours before the start of the tour.

The guide has the authority to make changes to the flow of the program without prior notice for the safe completion of the tour, public order, the peace of the guests, and operational necessities. This situation cannot be interpreted as a defective service.

Article 2 – Limits of Guest Requests in Case of Force Majeure In the situations specified in Article 1, the guest has the right to use only one of the following rights:

  • Participating in the tour at a future date determined by the agency,

  • Transferring the balance to another tour program deemed appropriate by the agency,

  • Or a fee refund.

In case a fee refund is requested, the refund will be processed within a maximum of 14 (fourteen) days from the date the guest makes a written application to the agency.

The agency cannot be held liable for any responsibility or compensation due to delays caused by banks after the refund process has been completed by the agency.

Article 3 – Cancellations Made by the Guest (Limitation of the Right of Withdrawal) The guest unconditionally accepts the following deductions based on the time remaining until the start of the tour:

  • 60 days or more remaining → The entire amount paid is refunded.

  • 59 – 31 days remaining → 25% of the tour fee is deducted.

  • 30 – 15 days remaining → 50% of the tour fee is deducted.

  • 14 – 7 days remaining → 75% of the tour fee is deducted.

  • Less than 7 days remaining → The entire tour fee is deducted (no refund).

These deductions represent the compensation for the damages the agency will incur and cannot be objected to by the guest. The 14-business-day refund period cannot be the subject of any compensation or interest claim under any circumstances.

Article 4 – Promotional, Campaign, and Special Priced Products There is strictly no right to cancellation, modification, date shifting, or refund for all products sold with promotions, campaigns, discounts, special prices, limited quotas, and advantageous prices.

Article 5 – Payment, Bank, and Commission Deductions In payments made via credit card, debit card, or wire transfer/EFT, the guest will be informed when the cancellation/refund process is completed.

The time it takes for the fee to reflect on the card is entirely at the discretion of the banks, and the agency cannot be held liable for this process.

Bank commissions, POS deductions, service fees, and operational expenses are not refunded under any circumstances.

Additional Article – Early Booking and Insurance There is no right to cancellation or modification in tour programs that include early booking, early payment, and special discounts.

In such tours, the right to cancellation and modification is only valid for guests who have purchased early booking insurance.

Article 6 – Special Products, Health, and Death Cases In special products; provided that the guest documents the illness of themselves or their first-degree relatives, which coincides with the tour date and prevents their usual occupation for 10 days, with an official report obtained from a fully equipped state hospital, or proves the case of death with official documents:

  • If there are more than 30 days until the start of the tour, only the remaining amount excluding the flight ticket will be refunded.

  • If there are less than 30 days remaining, no refund will be made.

Reports and documents must be submitted to the agency before the start of the tour.

Article 7 – No-Show (Non-Participation in the Tour) In the event that the guest misses the start of the tour, is late, or fails to notify in writing that they will participate in the tour; the agency may unilaterally cancel all reservations and services made on behalf of the consumer.

In this case, the entire amount is forfeited, and no refund will be made.
